The practice is limited to the provision of neutral services to industry, governmental agencies and individuals. The services provided are in two categories:
The firm’s goal is to provide creative and rational solutions to parties undergoing conflict in the workplace. We work with the parties to define mutually acceptable resolutions, encourage ongoing collaboration and facilitate respect.
Our neutrals are committed to the highest standards of conduct and abide by the Standards and Practices for Labor Arbitrators established by the American Arbitration Association. We work on a national and international basis in both the private and public sectors. While primarily ADR practitioners, we work closely with university academics and researchers to stay current on ADR trends.
We recognize and consider the unique nature of each client. The firm will manage each project to produce solutions that focus on those individual needs. Each client is served by a team that is carefully selected for the particular project, and delivers peak performance through a combination of tools, skills, and experience.
Unlike law firms, we ensure the personal involvement of our senior leadership on each project and for each client. Our commitment is to integrity, confidentiality and discretion.
The firm differs from many law firms who have arbitration/mediation as an “ancillary business”. Davidson Arbitration’s professional staff are full-time neutrals with significant experience and specific training in both the domestic as well as international Alternative Dispute Resolution (ADR) field.
Workplace Mediation and Arbitration
Davidson Arbitration, LLC, an Atlanta-based firm, is a full-service provider of alternative dispute resolution (ADR) services throughout the United States. The practice provides mediation and arbitration of commercial and employment grievances/disputes or terminations. Our team has extensive experience in all aspects of labor-management relations issues that can come before a mediator/arbitrator and serve on the panels of the following labor arbitration/mediation providers:
American Arbitration Association
National Mediation Board
Financial Industry Regulatory Authority (FINRA)
In employment arbitration/mediation, we have heard and ruled on disputes involving age, race, and gender discrimination, wrongful discharge, sexual harassment, layoffs, failure to promote, and retaliation. Specialty areas include:
Disputes involving highly paid executives, arising from employment agreements or severance agreements
Disputes involving whistleblower/retaliation claims, arising from protected activity or retaliation under environmental laws, Sarbanes-Oxley Act, and the Energy Reorganization Act.
Disputes involving federal employees, arising from terms and condition of federal employment.
In commercial forums, we have heard disputes involving aviation, automotive sales and repairs, and personal services. Two of our specialty areas include:
Disputes arising from settlement of class action litigation and mass claims
Disputes involving securities or employment under the National Association of Securities Dealers (NASD) and/or FINRA.
In association with the firm Workplace Resolutions, Davidson Arbitration is pleased to offer access to the specialized product known as The Collaborative Workplace. This service is a national provider of consulting services in organizational development; including facilitation, executive coaching, change management, strategic planning, leadership assessment, and conflict coaching. The objective is to enhance employee productivity, morale and innovation through collaboration.
The consultants, Richard Fincher and Rocco Scanza, are nationally recognized in the provision and development of teambuilding and retreats for groups and organizations. Recent teambuilding has been conducted for Coconino Community College, Tompkins County (New York) Government, Heraeus Corporation, and TSA/Homeland Security.
Executive mediation is an emerging tool to resolve interpersonal-driven disputes within the workplace. There are no legal claims or attorneys representing the executives. The common issues include personality conflicts, policy, resource and decision-making disputes.
We offer an integrated series of conflict management seminars (new mediator training, HR briefings) which effectively link theory and practice through innovative curriculum and an adult learning model.
